Terms of use
These terms govern the use of SoaringMarket (soaringmarket.eu) between the operator named in the legal notice and its users.
1. The service
SoaringMarket lets users publish listings for gliders, towplanes, instruments and gliding equipment and contact each other. SoaringMarket is not a party to contracts between users and provides no payments, escrow, inspections or guarantees. Use is currently free of charge.
2. Your account
You must be at least 18 years old and provide truthful information. Each person may have only one account. Keep your password confidential; you are responsible for activity in your account. You can delete your account at any time on your account page.
3. Listings
Only offer items you are entitled to sell, and describe them truthfully, including significant defects, damage history and airworthiness status. Photos must show the item offered, and you must hold the rights to them. Listings must not contain advertising unrelated to the item. Published listings go offline automatically after 90 days unless they are renewed.
4. Prohibited content and conduct
Prohibited are in particular unlawful or stolen goods, fake or misleading listings, content that infringes third-party rights, discriminatory or offensive content, spam, harassment, collecting other users' data and attempted fraud such as requests for advance payment through unusual channels.
5. Reports and moderation
Anyone can report content that may be unlawful or breach these terms: signed-in users with Report listing or Report user, everyone else with the contact form. Reports are checked by a person. We may withdraw listings, block conversations and deactivate or delete accounts that breach these terms or the law. The affected user is informed of the decision and the reason by email and can object using the contact form; the decision is then reviewed again.
6. Contact point
Our point of contact for users and authorities under the EU Digital Services Act is the contact form and the email address in the legal notice. You can write to us in German or English.
7. Liability
SoaringMarket does not check listings before publication and is not liable for the accuracy of user content or the conduct of users. We are liable without limitation for intent, gross negligence and personal injury; otherwise, liability for slight negligence is excluded as far as permitted by law. We do not guarantee that the website is always available.
8. Changes
We may change these terms for the future, for example for new features or legal requirements. Registered users are informed of significant changes by email in advance.
9. Applicable law
Austrian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, the mandatory consumer protection rules of your country of residence remain unaffected.
